CONDITIONS FOR USE

NOTICE :

These general conditions for use of the Gallica web site, the address for which is http://heritage.bnf.fr/france-ameriques and hereinafter called “the Web Site”, set out the conditions for use of the Web Site by web users.
By browsing the Web Site, its web users (hereinafter called “the web users”) acknowledge that they have read the Web Site’s legal notices, and they accept these general conditions for use (hereinafter called “the GCUs”).

The applicable GCUs are those that are accessible on line on the Web Site on the day when web users log on to the Web Site.

The BnF reserves the right to, at any time, modify the GCUs to adapt them to legislative and regulatory developments, or to new Web Site functionalities that may be offered to web users, by publishing a new version on the Web Site. The date of the latest update to the GCUs is given in the first line of this document.

 

1. PURPOSE

The purpose of these GCUs is to determine and govern the terms on which the Web Site is used by web users.
The GCUs are supplemented by the Conditions for Use of content on the Gallica web site and the sites of the various partners, which define and frame the terms on which web users reuse the documents of which the links are given.

 

2. CONDITIONS AND TERMS FOR USING THE WEB SITE

The Site enables web users to consult on line a set of digitised documents taken from the collections of the BnF or partner institutions, as well as their descriptions.

In addition, web users can:
- share documents on social networks or on other web sites
- be redirected to the other web sites of the BnF, or of the BnF’s institutional or commercial partners,
- contact the web site administrators.

 

3. CONDITIONS FOR ACCESSING THE WEB SITE

Using the Web Site requires an internet connection, preferably a high-speed one. Please note that the BnF is not responsible for that connection.

Web users can browse the Web Site on a personal computer or any other mobile device (e.g. tablet, telephone, etc.) that allows internet access.

 

4. WEB USERS’ UNDERTAKINGS AND RESPONSIBILITIES

When web users use the Web Site, they undertake not to infringe current legislative and regulatory provisions and these GCUs. Web users are hereby informed that any infringement of the said provisions may lead to legal proceedings and sanctions against those web users.

Web users acknowledge that if their use of the Web Site is contrary to these GCUs and, more generally, to current laws and regulatory provisions, the BnF reserves the right, immediately and without notice, to block those web users’ access to the Web Site.

Generally, the BnF cannot be held liable if the web users use the Web Site other than in accordance with these GCUs.

 

5. PERSONAL DATA AND COOKIES

    5.1 Personal data collected on the Web Site directly from users

The heritage.bnf.fr/france-ameriques site does not collect any data without your knowledge, and does not pass any data to third parties. E-mail addresses and any personal information are not passed on or used, and they are only retained for the period needed for their processing.

    5.2 Data collected indirectly from Web Site users (“Cookies”)

In order to improve service, a statistics-management tool measures the number of visits, the number of pages viewed, and visitor activity on the web site. When you browse the web site, the information gathered does not contain any personal information.
Those data are not passed on to third parties or used for other purposes.
By changing your internet-browser configuration, you can, at any time, prevent cookies from being stored and delete existing cookies, without harming the quality of your browsing on the web site.

 

6. CONDITIONS FOR USE OF WEB SITE CONTENT

Reusing the Web Site content is framed by the conditions for use of Gallica content and the content of partner web sites, which can be accessed at: http://gallica.bnf.fr/html/und/conditions-dutilisation-des-contenus-de-gallica for Gallica and on the various partner web sites.
Web users undertake to seek information and to comply with the conditions for use in relation to any reuse they may make of content.

 

7. INTELLECTUAL PROPERTY RIGHTS

    7.1 Intellectual property rights relating to the Web Site, brands, and logos

The Bibliothèques d’Orient web site (graphics charter, logos, domain name, and the various elements that constitute them) is the sole property of the Bibliothèque nationale de France, and is protected under the provisions of the Intellectual Property Code.
Consequently, any reuse of those elements without the express authorisation of the Bibliothèque nationale de France would constitute piracy that is punishable under the terms of the Intellectual Property Code and the Criminal Code. The brands, trade names, and logos that appear on this site are registered trademarks. Their total or partial reproduction based on elements from the site is prohibited.

Web users undertake not to use the Web Site in a way that would constitute a violation or an infringement of legislation and regulations made under French law.

   7.2 Intellectual property rights relating to the Web Site’s content

Certain digitised documents distributed on the Web Site are subject to intellectual property rights. Their reuse is subject to prior authorisation from the rightsholders as well as to the conditions for use of Gallica content.

 

8. APPLICABLE LAW - DISPUTES

The Web Site and these General Conditions for Use are subject to French legislation. In the event of a dispute, competence shall lie with the French courts.
